Terms and Conditions & Refund Policy

These Terms and Conditions (the “Terms”) govern the use of our dental start-up platform (the “Platform”) by dentists and patients (collectively referred to as “Users” or “You”). By using our Platform, You agree to be bound by these Terms. Please read these Terms carefully before using our Platform.

1. Definitions

In these Terms, the following words and phrases have the meanings ascribed to them below:

  1. Dentist: means a dental professional who is registered with the appropriate regulatory authority to provide dental services.
  2. Patient: means an individual who is seeking dental services.
  3. Platform: means our website, mobile application, or any other digital platform used to provide dental services to Patients.
  4. Service: means the dental services provided by the Dentists through the Platform.
  5. We, us, our, and the company: refer to the dental startup that owns and operates the Platform.

2. Eligibility

  1. To use the Platform as a Patient, You must be an Indian Citizen 18 years of age or older and legally capable of entering into a binding contract.
  2. To use the Platform as a Dentist, You must be a registered dental professional in good standing with the appropriate regulatory authority.
  3. We reserve the right to refuse service to anyone at any time.

3. User Accounts

  1. You may be required to register an account to use certain features of the Platform. You agree to provide accurate, complete, and current information about Yourself during the registration process.
  2. You are solely responsible for maintaining the confidentiality of Your account and password, and for restricting access to Your account. You agree to accept responsibility for all activities that occur under Your account or password.
  3. You agree to notify us immediately if You become aware of any unauthorized use of Your account or password, or any other breach of security.

4. Use of the Platform

  1. You agree to use the Platform for lawful purposes only.
  2. You agree not to use the Platform to:
    1. upload, post, email, or otherwise transmit any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
    2. impersonate any person or entity, including, but not limited to, a company official, forum leader, guide or host, or falsely state or otherwise misrepresent Your affiliation with a person or entity;
    3. interfere with or disrupt the Platform or servers or networks connected to the Platform, or disobey any requirements, procedures, policies or regulations of networks connected to the Platform;
    4. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the Indian Securities and Exchange Commission, any rules of any national or other securities exchange and any regulations having the force of law;
    5. "stalk" or otherwise harass another; or
    6. collect or store personal data about others.

5. Conditions that must be agreed by all users

  1. Happy smile only gives the list of doctors who will agree to provide discounts. Happy smile is not suggested or recommended by any special doctor to any patient or person beyond other doctors.
  2. Happy smile gives membership to certified doctors only. Even though any uncertified doctor tries to join us, it will be removed by the happy smile and membership fees will not be refundable.
  3. We do not recommend any uncertified doctor to anyone.
  4. Doctors who are members of us are liable to do treatment of the member patients according to treatment rates advised and suggested by happy smile.
  5. If they need to take any extra charges or fees for any treatment, they should inform member patients prior to the start of the treatment.
  6. Doctors and their hospitals are the only liable and responsible to their patients (patients/persons/group of people who are members of happy smile) for treatments, activities, medication, and other diagnosis and treatment-related things performed.
  7. Happy smile is not liable or responsible for the quality of any above-mentioned activities, and no legal action can be taken by any member.
  8. Patients/members are free to choose any doctor for their and their beloved ones' treatment. We are not influenced to select any particular doctor. Members are only responsible for their selection.
  9. Our social media pages are only for marketing purposes only. Any focus or recommendation of a doctor is only for marketing purposes and a personally happy smile or their founder does not recommend any of them to other doctors. Happy smile is not liable for the selection of doctors by members/patients.
  10. Patients and doctors are responsible and liable to each other for any financial, personal, verbal activities done between them. Happy smile will not be bound to interfere in between them.
  11. Patients are advised to ask and finalize fees/rates and packages of treatment. Happy smile is not responsible or liable for any change in treatment rates.
  12. Happy smile is not responsible for any doctors' debt or pending fees of our members and Happy smile is not liable to give such pending fees.
  13. Doctors and patients/members are not liable to give any commission for treatment costs to any employee with happy smile. Happy smile does not allow such activities, and Happy smile is not responsible for that.
  14. Happy Smile is only liable to take the membership fees from their doctors and patients, and we accept only online payments through our application. No membership will be given by offline payment or other payment mode.
  15. Happy smile is not responsible and suggests any product or advertising listed on their website and application. No claims will be accepted and considered regarding that.

6. Refund Policy

  1. We may not be responsible for the failure of payment, even if for any reason user's payment is deducted and we have received it, then it will be fully refunded in 7 working days.
  2. If not received in 7 working days, email us and appropriate action will be taken and will be informed or revert back to the complainer.
  3. Membership will be given only after receiving payment.
  4. If any member leaves membership in between the membership period, no refund will be provided or eligible.
  5. Membership will be discontinued automatically after 1 year if not renewed again.
  6. Commission amount is finalized by happy smile only and whatever amount is decided by us can be modified anytime.
  7. All amount will be credited to the respective wallet.
  8. All the rights of changing the commission percentage rates will be preserved with happy smile only.
  9. Commission/referral points/service points/earned money decided by Happy smile cannot be changed.
  10. We do not represent this as any policy like dental insurance policy or any health policy.
  11. Dental membership plans work differently than traditional dental insurance plans. It is important to carefully review the terms and conditions of the dental membership plan before signing up in order to understand the refund policy and any other obligations or restrictions associated with the plan. If you have specific questions or concerns about the refund policy for a particular dental membership plan or complain regarding any service of happy smile, you should contact the organization or business first that provides it for more information.
